The activities, rights and obligations of the customs representative are governed by Chapter 55 of the Customs Code of the EAEU, as well as Chapter 60 of Federal Law No. 289-FZ of August 3, 2018 “On customs regulation in the EAEU and on amendments to certain legislative acts of the EAEU”
The customs representative is the official representative of the customs declarant when carrying out operations as part of the customs clearance procedure for goods or cargo, in accordance with the concluded agreement
Thus, the customs representative is the link between the foreign economic activity participant (customs declarant) and the customs authorities. Only a legal entity registered in the register of customs representatives of the relevant EAEU member state can act as a customs representative.
One can check whether the organization is included in the register of customs representatives on the official website of the Federal Customs Service.
Since, when performing customs operations, the customs representative acts on behalf of and by order of the declarant, he, as a rule, has the same rights as the person who authorizes him to represent his interests in relations with the customs authorities
